Welcome to Cal Auto Group. By accessing or using calautogroup.com (the “Site”) and any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Site.

These Terms apply to all visitors, users, and customers of the Site, regardless of how you access it. Please read these Terms carefully alongside Cal Auto Group’s Privacy Policy, available at calautogroup.com/privacy-policy, which is incorporated herein by reference.

Section 1 — Acceptance of Terms

By accessing, browsing, or using the Site in any manner — including viewing listings, submitting inquiries, scheduling service, or creating an account — you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. Your continued use of the Site constitutes ongoing acceptance of any modifications to these Terms.

Modifications. Cal Auto Group reserves the right to modify, update, or replace these Terms at any time at our sole discretion. When we make material changes, we will update the “Last Updated” date at the top of this page. We may also provide additional notice (e.g., via email or a prominent Site notice). Your continued use of the Site following the posting of revised Terms constitutes your acceptance of those changes.

Minors. The Site is not directed to individuals under the age of 18. Minors under 18 years of age may only use the Site with the active involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on the minor’s behalf. Minors may not independently engage in vehicle transactions, submit credit applications, or create accounts.

Business Users. If you access or use the Site on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and “you” and “your” shall refer to both you individually and that entity.

Section 2 — Eligibility and User Accounts

2.1 Eligibility

To use the Site independently, engage in vehicle transactions, or submit financing or credit applications, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. By using the Site, you represent and warrant that you meet all eligibility requirements set forth in these Terms.

2.2 Account Creation

Certain features of the Site — such as service scheduling portals, saved vehicle searches, or financing application tracking — may require you to register for a user account. If you create an account, you agree to the following:

  • You will provide accurate, complete, and current information during registration and keep your account information updated at all times.
  • You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username and password.
  • You are responsible for all activities that occur under your account, whether or not authorized by you.
  • You must notify us immediately at michael@calautogroup.com if you become aware of any unauthorized access to or use of your account.
  • Cal Auto Group reserves the right, in its sole discretion, to suspend, deactivate, or terminate any account at any time, with or without notice, for any reason, including violation of these Terms.
  • You may not transfer, sell, or assign your account to any third party without our prior written consent.

2.3 Prohibited Users

Access to and use of the Site is prohibited for any individual or entity that has previously been suspended, banned, or otherwise prohibited by Cal Auto Group from using the Site or any of our Services. Circumventing any suspension or ban — including by creating a new account — is a violation of these Terms and may result in further action, including legal remedies.

Section 3 — Use of the Site

3.1 Permitted Uses

The Site is made available for lawful purposes related to vehicle research, new and pre-owned vehicle sales and leasing inquiries, financing inquiries, service scheduling, and the exploration of general automotive information and resources. You may use the Site for personal, non-commercial, or legitimate commercial purposes consistent with these Terms.

3.2 Prohibited Conduct

You agree that you will not, under any circumstances, do any of the following in connection with your use of the Site:

  • Use the Site for any unlawful purpose or in violation of any federal, state, or local laws, regulations, or ordinances.
  • Scrape, crawl, spider, index, or otherwise harvest data, content, vehicle listings, or user information from the Site using bots, automated tools, scripts, or any other means without our prior express written permission.
  • Attempt to gain unauthorized access to any portion of the Site, its related systems, servers, databases, or networks connected to the Site.
  • Transmit or upload viruses, malware, ransomware, spyware, Trojan horses, or any other harmful, disruptive, or destructive files or code.
  • Impersonate any person or entity, including any Cal Auto Group employee, officer, or representative, or falsely state or misrepresent your affiliation with any person or entity.
  • Use the Site to send unsolicited commercial communications, spam, chain letters, phishing messages, or any other form of unauthorized advertising or solicitation.
  • Interfere with or disrupt the integrity, performance, or security of the Site, its infrastructure, or any servers or networks connected to the Site.
  • Copy, reproduce, modify, adapt, translate, distribute, publish, publicly display, or create derivative works from any content, material, or data on the Site without our prior express written consent.
  • Post, transmit, or submit any content that is false, misleading, defamatory, libelous, harassing, abusive, obscene, threatening, hateful, or otherwise objectionable.
  • Use the Site in any manner that could, in our sole judgment, damage, disparage, or harm the reputation, goodwill, or business interests of Cal Auto Group.
  • Collect or store personal data about other users without their explicit consent.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices displayed on or through the Site.

Violation of any of the above prohibitions may result in immediate suspension or termination of your access to the Site and may subject you to civil or criminal liability.

Section 4 — Vehicle Listings and Inventory

4.1 Accuracy of Listings

Cal Auto Group makes commercially reasonable efforts to ensure that vehicle listings on the Site are accurate, current, and complete. However, by using the Site, you acknowledge and agree that:

  • All vehicle listings are subject to prior sale, availability, and change without notice.
  • Prices displayed on the Site are subject to change and may not include applicable federal, state, or local taxes; title and registration fees; dealer documentation fees; smog fees; or dealer-added accessories and installed options.
  • Photographs, renderings, and images of vehicles on the Site are provided for illustrative purposes only and may not exactly represent the specific vehicle available for sale, including color, trim level, options, or accessories.
  • Mileage figures shown on pre-owned vehicles reflect odometer readings at the time of listing and may change due to test drives, transportation, or other factors prior to sale.
  • Vehicle specifications, features, and descriptions are provided by third-party data sources and manufacturers and may contain errors or omissions.

We encourage you to contact our sales team directly to confirm current vehicle availability, specifications, and pricing before visiting a dealership location.

4.2 No Guarantee of Availability

The display of a vehicle listing on the Site does not constitute a reservation, hold, deposit, or guarantee of availability. Vehicles may be sold, transferred, or otherwise become unavailable while still appearing as listed on the Site. Cal Auto Group is not responsible or liable for any inconvenience resulting from the unavailability of a listed vehicle.

4.3 Pricing Errors

In the event of a pricing error — whether typographical, computational, or otherwise — Cal Auto Group expressly reserves the right to cancel, decline, or refuse to honor any order, inquiry, or agreement based on incorrect pricing. In such circumstances, we will use commercially reasonable efforts to notify affected users promptly and will offer a corrected price or the option of a full cancellation without penalty. Cal Auto Group shall not be liable for any damages, costs, or losses arising from pricing errors on the Site.

4.4 Trade-In Estimates

Any trade-in value estimates, instant cash offer tools, or vehicle valuations provided on or through the Site are preliminary, non-binding, and for informational purposes only. All trade-in values are subject to physical inspection, verification of vehicle condition, history, mileage, and final appraisal conducted in person at a Cal Auto Group dealership location. A preliminary online estimate does not constitute a binding offer to purchase your vehicle.

Section 5 — Financing and Credit Applications

5.1 No Guarantee of Financing

Submitting a credit application, pre-qualification request, or financing inquiry through the Site does not constitute a loan approval, commitment to lend, extension of credit, or binding financing agreement of any kind. All financing arrangements are subject to final credit approval by participating third-party lenders, subject to the lender’s underwriting criteria, verification of the information provided, and market conditions at the time of final approval.

5.2 Credit Inquiries and Authorization

By submitting a credit application or financing inquiry through the Site, you expressly authorize Cal Auto Group and its affiliated lending partners and financial institutions to:

  • Obtain your consumer credit report(s) from one or more credit reporting agencies;
  • Verify the personal, employment, and financial information you have provided;
  • Share your application information with lenders, financial institutions, and other service providers as necessary to evaluate and process your application;
  • Contact you via phone, email, or mail regarding your application and related financing offers.

Please be aware that submitting a credit application may result in a hard inquiry on your credit report, which could temporarily affect your credit score.

5.3 Third-Party Lenders

Cal Auto Group is an automotive dealership group — we are not a bank, credit union, or licensed lender. Vehicle financing arranged through the Site or at our dealership locations may be facilitated through relationships with independent, third-party financial institutions and lenders. Interest rates, annual percentage rates (APR), loan terms, monthly payment amounts, and all other financing conditions are set exclusively by the applicable lender and are subject to change without notice. We are not responsible for the decisions, terms, or conduct of third-party lenders.

5.4 Accuracy of Financial Information

You represent, warrant, and agree that all personal and financial information submitted in connection with any credit application or financing inquiry through the Site is true, accurate, complete, and not misleading. You understand that providing false, inaccurate, incomplete, or misleading information in a credit application may constitute fraud and could result in denial of your application, cancellation of any financing arrangement, and potential civil or criminal legal consequences.

Section 6 — Service Scheduling and Appointments

6.1 Appointment Requests

Service appointment requests submitted through the Site’s online scheduling tool are requests only and are not confirmed appointments until you receive an explicit confirmation from our service department via email, phone, or other communication. Cal Auto Group reserves the right to decline or reschedule any appointment request based on technician availability, parts availability, or other operational requirements.

6.2 Cancellations and No-Shows

We respectfully request that you cancel any appointment you are unable to keep with at least 24 hours’ advance notice. Timely cancellation allows us to accommodate other customers in need of service. Repeated no-shows or late cancellations may affect our ability to schedule future appointments for you.

6.3 Service Estimates

Any service cost estimates, labor quotes, or maintenance recommendations provided through the Site, by email, or by telephone are preliminary, non-binding, and for informational purposes only. Final service costs will be determined upon physical inspection and diagnosis of your vehicle by our service technicians. Additional repairs or services that are identified during inspection will be separately communicated to you and will require your authorization before any additional work is performed.

6.4 Limitations of Liability for Service

Cal Auto Group and its service personnel will exercise reasonable care in the handling and servicing of your vehicle. However, Cal Auto Group is not responsible for vehicle damage, loss, theft, or injury arising from circumstances beyond our reasonable control, including but not limited to weather events, acts of third parties, pre-existing vehicle conditions, or circumstances unrelated to our service operations.

Section 7 — Intellectual Property

7.1 Ownership

The Site and all of its content — including but not limited to text, articles, graphics, logos, photographs, vehicle images, audio clips, video content, software, source code, databases, and compilations — are the property of Cal Auto Group or its content licensors and are protected by applicable United States and international copyright, trademark, trade secret, patent, and other intellectual property laws. All rights not expressly granted herein are reserved.

7.2 Limited License to Users

Subject to your compliance with these Terms, Cal Auto Group grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site solely for your personal, non-commercial purposes. This limited license expressly does not include the right to:

  • Reproduce, duplicate, copy, sell, or resell any portion of the Site or its content;
  • Publicly display, perform, or distribute Site content;
  • Modify, adapt, translate, reverse-engineer, decompile, disassemble, or create derivative works based on the Site or its content;
  • Use any data mining, robots, scrapers, or other automated data-gathering or extraction tools on the Site;
  • Frame, mirror, or deep-link to any portion of the Site without our prior express written permission;
  • Remove or alter any copyright, trademark, or other proprietary notices from any content on the Site.

Any use of the Site or its content beyond the scope of this limited license is strictly prohibited and may constitute infringement of Cal Auto Group’s intellectual property rights.

7.3 Trademarks

“Cal Auto Group,” the Cal Auto Group logo, and all related product names, service names, slogans, and trade dress are trademarks or registered trademarks of Cal Auto Group in the United States and may be registered in other jurisdictions. You may not use these marks without our prior written consent. Third-party brand names, vehicle manufacturer logos, model names, and trademarks referenced on the Site are the property of their respective owners and are used solely for identification and reference purposes. Their use does not imply any affiliation with, endorsement by, or sponsorship by Cal Auto Group, and Cal Auto Group makes no claim of ownership over such third-party marks.

7.4 User-Submitted Content

If you submit, post, upload, or otherwise make available any reviews, ratings, comments, photographs, videos, suggestions, feedback, or other content to or through the Site (“User Content”), you represent that you have all necessary rights to do so and that your User Content does not violate these Terms, any applicable law, or any third-party rights. By submitting User Content, you grant Cal Auto Group a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, sublicensable license to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and publicly display such User Content in any media for any purpose related to our business, including marketing and promotional use, without further compensation to you. You waive any moral rights you may have in such User Content to the fullest extent permitted by applicable law.

Section 8 — Third-Party Links and Services

The Site may contain hyperlinks, integrations, or references to third-party websites, platforms, applications, tools, or services, including but not limited to financing calculators, vehicle history report services (such as Carfax or AutoCheck), mapping and navigation services, review platforms, and social media networks. These links and integrations are provided solely for your convenience and informational purposes.

Cal Auto Group does not endorse, control, operate, or assume any responsibility for the content, accuracy, privacy practices, products, services, or opinions expressed on any third-party website or service. We make no representations or warranties regarding the quality, reliability, or legality of any third-party content, products, or services. Your access to and use of any third-party website or service is entirely at your own risk and is governed solely by the terms of service and privacy policies of that third party. We encourage you to review the applicable terms and privacy policies of any third-party service you access through the Site.

The inclusion of any link to a third-party website does not imply that Cal Auto Group endorses, sponsors, or has any affiliation with the linked site or its operator.

Section 9 — Disclaimers and Limitation of Liability

While Cal Auto Group strives to present accurate and current vehicle listings, pricing, specifications, and availability information, we make no warranty, express or implied, that such information is complete, current, accurate, or error-free. Vehicle listings are provided for general informational purposes and should not be relied upon as the sole basis for any purchase decision. We strongly encourage you to confirm all details directly with a Cal Auto Group sales representative prior to making any purchase decision.

9.3 Limitation of Liability

Some jurisdictions, including the State of California, may not allow the exclusion of certain implied warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you to the extent prohibited by applicable California law. In such cases, the exclusions and limitations set forth above shall apply to the maximum extent permitted by California law.

Section 10 — Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Cal Auto Group, its parent companies, subsidiaries, and affiliates, and each of their respective officers, directors, shareholders, employees, agents, contractors, licensors, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, proceedings, liabilities, obligations, losses, damages, judgments, settlements, costs, and expenses — including reasonable attorneys’ fees and court costs — arising out of or related to:

  • Your access to or use of the Site or any Services;
  • Your violation of any provision of these Terms;
  • Your violation of any applicable federal, state, or local law, regulation, or ordinance;
  • Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or right of publicity;
  • Any User Content you submit, post, or transmit through the Site;
  • Any misrepresentation made by you in connection with your use of the Site or any application or inquiry submitted through the Site.

Cal Auto Group reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with Cal Auto Group in asserting any available defenses. You agree not to settle any such matter without the prior written consent of Cal Auto Group.

Section 11 — Privacy

Your use of the Site is subject to Cal Auto Group’s Privacy Policy, which is incorporated into these Terms by reference in its entirety. The Privacy Policy describes how we collect, use, share, protect, and retain your personal information, including information collected through the Site, service scheduling tools, credit applications, and other interactions with Cal Auto Group.

By accessing or using the Site, you acknowledge that you have read and understood our Privacy Policy and consent to the collection, use, and sharing of your information as described therein. The Privacy Policy is available at:

Section 12 — Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice or conflict of law provisions or rules that would cause the application of the laws of any jurisdiction other than California.

12.2 Venue and Jurisdiction

For any disputes not subject to arbitration as set forth below, you and Cal Auto Group agree that any legal action or proceeding shall be brought exclusively in the state courts of [Insert County] County, California, or the United States District Court for the applicable federal district in California. You and Cal Auto Group each irrevocably submit to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

12.3 Informal Dispute Resolution

Before initiating any formal legal proceeding or arbitration, you agree to first contact Cal Auto Group at michael@calautogroup.com and provide a written description of the dispute, the specific relief sought, and your contact information. Cal Auto Group will similarly attempt to resolve any dispute it has with you informally. Both parties agree to negotiate in good faith for a period of at least thirty (30) days from receipt of the written notice before initiating formal proceedings. This informal resolution requirement is a condition precedent to initiating arbitration or litigation.

12.4 Binding Arbitration

For eligible disputes (excluding disputes relating to the enforcement of intellectual property rights, requests for injunctive or other equitable relief, and claims eligible for small claims court), you and Cal Auto Group agree to resolve disputes through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the arbitration is initiated. The arbitration shall be conducted in [Insert County] County, California, unless the parties agree otherwise. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. YOU AND CAL AUTO GROUP EACH AGREE THAT ALL ARBITRATION PROCEEDINGS SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING, AND NO ARBITRATOR SHALL HAVE AUTHORITY TO CONSOLIDATE CLAIMS OR TO OTHERWISE CONDUCT CLASS-WIDE PROCEEDINGS.

12.5 Jury Trial Waiver

13.1 California Consumer Privacy Act (CCPA/CPRA)

If you are a California resident, you have specific rights regarding your personal information under the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA), including the right to:

  • Know what categories of personal information we collect, use, disclose, and sell or share;
  • Access the specific pieces of personal information we have collected about you;
  • Request deletion of your personal information, subject to certain exceptions;
  • Correct inaccurate personal information we hold about you;
  • Opt out of the sale or sharing of your personal information for cross-context behavioral advertising;
  • Limit the use and disclosure of your sensitive personal information;
  • Non-discrimination for exercising your CCPA/CPRA rights.

13.2 California Civil Code § 1789.3 — Consumer Complaint Notice

Under California Civil Code Section 1789.3, California residents who use the Site are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

13.3 California Lemon Law Notice

New and certain pre-owned vehicles sold by Cal Auto Group may be eligible for coverage under California’s Song-Beverly Consumer Warranty Act, commonly referred to as the California Lemon Law. This law provides certain protections and remedies to consumers who purchase or lease vehicles that fail to conform to applicable warranties after a reasonable number of repair attempts. Consumers should carefully review the warranty documentation and disclosures provided at the time of purchase. For more information regarding California Lemon Law rights, please visit the California Department of Consumer Affairs at dca.ca.gov or consult with a qualified attorney.

Section 14 — Digital Millennium Copyright Act (DMCA)

Cal Auto Group respects the intellectual property rights of others and expects users of the Site to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, Cal Auto Group will respond promptly to claims of copyright infringement committed using the Site if such claims are reported to our designated DMCA Copyright Agent.

If you believe in good faith that content available on the Site infringes your copyright, please send a written DMCA takedown notice to our Copyright Agent that includes all of the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works;
  3. Identification of the material claimed to be infringing or the subject of infringing activity, with sufficient detail to allow Cal Auto Group to locate the material on the Site (e.g., URL);
  4. Your name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law;
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability. Cal Auto Group reserves the right to terminate the accounts of repeat infringers in appropriate circumstances.

Section 15 — Termination

Cal Auto Group reserves the right, in its sole and absolute discretion, to suspend, restrict, or permanently terminate your access to the Site, your account (if applicable), and any or all Services — at any time, with or without cause, and with or without advance notice — including for any violation of these Terms, any applicable law, or for any conduct that we determine, in our sole discretion, is harmful to our users, third parties, or our business interests.

Upon termination of your access:

  • Your right to access and use the Site immediately ceases;
  • Any licenses granted to you under these Terms are immediately revoked;
  • We may, but are not obligated to, delete your account information and User Content.

The following provisions of these Terms shall survive any termination or expiration of these Terms and continue in full force and effect: Section 7 (Intellectual Property), Section 9 (Disclaimers and Limitation of Liability), Section 10 (Indemnification), Section 12 (Governing Law and Dispute Resolution), Section 17 (Entire Agreement and Severability), and any other provisions that by their nature are intended to survive termination.

Section 16 — Force Majeure

Cal Auto Group shall not be held responsible or liable for any failure or delay in the performance of its obligations or the availability of the Site or Services when such failure or delay results from events, circumstances, or causes beyond our reasonable control (“Force Majeure Events”), including but not limited to:

  • Acts of God, natural disasters, earthquakes, floods, hurricanes, or other severe weather events;
  • Pandemics, epidemics, or public health emergencies declared by governmental authorities;
  • Acts of war, terrorism, riots, or civil unrest;
  • Government orders, regulations, embargoes, sanctions, or actions of governmental authorities;
  • Labor disputes, strikes, or work stoppages;
  • Failures of telecommunications networks, internet service providers, power grids, or third-party infrastructure;
  • Cybersecurity incidents, data breaches, or cyberattacks on Cal Auto Group or third-party service providers.

In the event of a Force Majeure Event, Cal Auto Group will use commercially reasonable efforts to resume normal operations as promptly as practicable. Nothing in this Section limits your rights as a California consumer under applicable consumer protection laws.

Section 17 — Entire Agreement and Severability

Entire Agreement. These Terms, together with the Cal Auto Group Privacy Policy and any other legal notices, policies, or agreements published on the Site and incorporated herein by reference, constitute the entire and exclusive agreement between you and Cal Auto Group with respect to your access to and use of the Site and Services. These Terms supersede and replace all prior or contemporaneous agreements, representations, warranties, and understandings between you and Cal Auto Group regarding the subject matter hereof, whether written or oral.
